A Florida couple is suing a fertility clinic after an alleged embryo error resulted in the birth of a child not biologically theirs.
A Florida couple has filed a lawsuit against Orlando fertility clinic IVF Life, Inc., and its lead doctor, Dr. Milton McNichol, after an alleged embryo mix-up led to the birth of a “non-Caucasian child” who was not biologically theirs. Tiffany Score and Steven Mills claim the clinic implanted another patient’s embryo in April 2025.
The couple said they immediately noticed something was wrong after giving birth on Dec. 11, 2025, because the baby “displayed the physical appearance of a racially non-Caucasian child.” Genetic testing later confirmed the child had “no genetic relationship” to either parent. Attorney John Scarola demanded the clinic unite the baby with her genetic parents and clarify the status of the couple’s stored embryos.
The lawsuit seeks emergency court action to require the clinic to alert affected patients, fund genetic testing, and disclose if other families were impacted. Scarola called the mix-up a “horrendous error,” while the court acknowledged Florida law offers little precedent. IVF Life said it is cooperating with an investigation to determine the source of the error.
