A Florida woman won $14 million after swallowing metal nails in Bruster’s ice cream, leaving her with permanent injuries and unable to have children.
A Florida woman, Brandy Buckley, won a $14 million judgment after unknowingly swallowing metal nails and shards hidden in a butter pecan ice cream from a Bruster’s shop in Palm Bay.
Buckley said she felt something stuck in her throat and initially mistook the nail for a pecan. Hospital X-rays confirmed the presence of sharp metal objects, which caused severe and permanent injuries, including neurological damage and scarring.
Buckley and her husband claim the incident left them unable to grow their family, while also resulting in massive medical bills and lost income.
The lawsuit accused Bruster’s of failing to ensure product safety, despite using certified ice cream makers. “The jury heard the evidence and rendered a verdict that was fair in light of the serious damages,” said Buckley’s attorney, Scott Alpizar.
